TRI-COUNTY LEAGUE WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK

By completing and submitting the registration form for participation in [TRI-COUNTY BASEBALL LEAGUE] (“the League”), I acknowledge that I have read, understand, and agree to the following Waiver, Release of Liability, and Assumption of Risk (“Agreement”). This Agreement is binding upon me, my heirs, assigns, personal representatives, and next of kin.

 

1. ASSUMPTION OF RISK

I understand and acknowledge that participation in baseball-related activities involves inherent risks, including but not limited to:

• Being struck by balls, bats, or equipment
• Collisions with other players, umpires, or objects
• Slipping, falling, or tripping on playing surfaces
• Injuries resulting from physical exertion or weather conditions
• Equipment failure or misuse
• Serious bodily injury, permanent disability, paralysis, or death

I voluntarily choose to participate with full knowledge and acceptance of these risks, whether known or unknown, foreseeable or unforeseeable.

 

2. RELEASE AND WAIVER OF LIABILITY

I hereby release, waive, discharge, and covenant not to sue:

• [TRI-COUNTY BASEBALL LEAGUE]
• League owners, directors, officers, employees, volunteers
• Coaches, umpires, officials
• Sponsors, affiliates, and partners
• Facility owners, operators, and municipalities
• Any other parties associated with the League

(collectively referred to as “Released Parties”)

from any and all claims, demands, causes of action, losses, or damages arising out of or related to my participation, including but not limited to claims based on negligence of the Released Parties, to the fullest extent permitted by law.

 

3. MEDICAL CONSENT AND RESPONSIBILITY

I certify that I am physically and medically capable of participating in baseball activities. I understand that the League does not provide medical insurance.

I hereby authorize the League to secure emergency medical treatment if deemed necessary and agree to be financially responsible for any medical care provided.

 

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including attorney’s fees) arising from:

• My participation
• My actions or omissions
• Any breach of this Agreement

 

5. EQUIPMENT AND CONDUCT

I agree to:

• Use equipment properly and as intended
• Follow League rules, safety guidelines, and umpire decisions
• Refrain from reckless, violent, or unsportsmanlike conduct

Failure to do so may result in removal from play without refund.

 

6. PHOTOGRAPHY, VIDEO, AND MEDIA RELEASE

I grant the League permission to use photographs, videos, or recordings of me for promotional, educational, or commercial purposes without compensation.

 

7. SEVERABILITY

If any portion of this Agreement is found invalid or unenforceable, the remaining portions shall continue in full force and effect.

 

8. GOVERNING LAW AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, and any legal action shall be brought in courts located within that state.

 

9. ACKNOWLEDGMENT AND ELECTRONIC SIGNATURE

I acknowledge that:

• I have read and fully understand this Agreement
• I understand that I am waiving substantial legal rights
• I agree that submission of the registration form constitutes my electronic signature and full acceptance of this Agreement
